Please read these Terms & Conditions carefully and in their entirety before using www.trainballistic.com (hereinafter referred to as the “Site”). The Site and its content are owned by Ballistic Performance, LLC.
PURPOSE: These Terms & Conditions are here to clearly explain, outline, and lay out the rules, terms, and conditions of using, viewing, and/or browsing the Site and/or purchasing or downloading any course, program, service, or product offered on or by us or the Site.
IMPORTANT NOTES: By using the Site in any capacity, you voluntarily agree to these Terms & Conditions. You agree that you have read, understood, and consented to these Terms & Conditions. If you have any questions, please contact us at hello@trainballistic.com.
You must be at least 18 years old and be able to consent to these Terms & Conditions. If you are under the age of 18, or you do not agree with these Terms & Conditions as stated herein, please STOP now and do not use this Site or its content. By using the Site, you agree to the Terms & Conditions as stated herein, regardless of whether or not you have read these Terms & Conditions.
These Terms & Conditions contain an Arbitration Clause and require you to dispute or resolve any claim with us through Arbitration. By agreeing to these Terms & Conditions, you agree to the Arbitration Clause and voluntarily waive your right to a jury trial.
By proceeding on the Site, you hereby agree to the following:
1. Definitions: “Company”, “We”, “Our”, or “Us” means Ballistic Performance, LLC and our website, www.trainballistic.com.
“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Ballistic Performance, LLC and/or www.trainballistic.com, and any and all written or downloadable material purchased, viewed, or otherwise offered by Ballistic Performance, LLC, including, but not limited to, blog posts, graphics, newsletters, designs, documents, information, videos, trainings, templates, and materials.
“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information includes, among other things, your name, address, email address, telephone number, birth date, mailing address, etc.
“Site, Courses, Services, and/or Products” means www.trainballistic.com, Content (as defined herein), email list/newsletters, social media posts, video trainings, blog posts, fitness programs, nutrition coaching, consultations, live or virtual coaching sessions, eBooks, forms, workbooks, webinars, website materials, and/or templates available on the Site.
“You” or “Your” means the user, customer, or viewer of the Site.
2. Consent: By using the Site and/or making any Purchase, you implicitly and voluntarily agree to act in accordance with, and abide by, these Terms & Conditions, our Privacy Policy, and Disclaimer.
By using the Site and/or making any Purchase, you represent and warrant that you are at least 18 years old. Any use of, or access to, the Site and its Content by anyone under the age of 18 is unauthorized and in direct violation of these Terms & Conditions and our Privacy Policy.
3. Site Rules: By using the Site and/or making any Purchase, you hereby agree & consent not to:
- Harass, abuse, or harm any person through or on the Site.
- Post or transmit content that is obscene, offensive, libelous, defamatory, or otherwise objectionable.
- Violate any applicable laws.

- Post content or materials that infringe on intellectual property rights.

- Copy, reproduce, or distribute our intellectual property without explicit permission.
4. Disclaimer: Ballistic Performance is operated by certified fitness and nutrition professionals. However, we are not medical doctors, therapists, or licensed medical professionals. All guidance, programs, and content are for informational and educational purposes only and should not be considered medical advice. Always consult your physician before making changes to your diet, exercise, or lifestyle.
We do not guarantee any specific results from our programs or coaching services. Outcomes depend on individual variables and adherence.
5. Your Consent to These Terms & Conditions: By using this Site, or purchasing or downloading from our Site, Services, and/or Products, you implicitly and voluntarily agree to these Terms & Conditions.
6. Changes to These Terms & Conditions: We reserve the right to modify these Terms & Conditions at any time without notice. The updated version will be indicated by an updated date at the bottom of this page. Continued use of the Site means you accept those changes.
7. Links to Third-Party Websites: The Site may contain links to third-party websites. We are not responsible for the content, practices, or policies of these websites. Please review their terms and privacy policies separately.
8. Intellectual Property Ownership: All content on the Site is the intellectual property of Ballistic Performance, LLC. Unauthorized use, reproduction, or distribution of our materials is strictly prohibited.
9. Our Limited License to You: You are granted a limited, non-exclusive license to access and use our Site and content for personal use only. Commercial use or unauthorized reproduction is strictly prohibited.
10. Your License to Us: If you submit content (comments, testimonials, media) to Ballistic Performance, you grant us the right to use that content for promotional or commercial purposes unless otherwise specified in writing.
11. Purchase & Access Terms: You agree not to share, distribute, or make publicly available any paid content or materials. Protect your login credentials. Violations may result in legal action.
12. Sharing the Site & Its Content: You may share our Site and content for personal use with appropriate attribution. Commercial sharing requires prior written consent.
13. No Claims Made Regarding Results: Client results shared on the Site are individual examples. They are not guarantees or promises of specific outcomes.
14. Disclaimer - No Warranties: All services, content, and products are provided “AS IS” without warranties of any kind. We make no guarantees regarding results, accuracy, or completeness.
15. Your Release of Us: By using the Site, you release Ballistic Performance, LLC and its team from any and all claims related to your participation in any program, course, or service.
16. Errors & Omissions: We do our best to keep information accurate, but we do not guarantee that all content is error-free or up to date. You are responsible for verifying any information before relying on it.
17. Refund Policy: All sales are final. We do not offer refunds for services already rendered or digital products already delivered.
18. Arbitration Clause: If a dispute arises, you agree to resolve it through binding arbitration under the American Arbitration Association rules, rather than in court. Arbitration will take place in the State of Pennsylvania. The arbitrator’s decision shall be final.
19. Governing Law: These Terms & Conditions are governed by and construed in accordance with the laws of the State of Pennsylvania.
20. Jurisdiction: You consent to the exclusive jurisdiction of the state and federal courts located in Pennsylvania.
21. Consent to Service: You agree that legal notices may be sent to you electronically or by mail as provided by Pennsylvania law.
22. Payment & Purchases: You authorize Ballistic Performance, LLC to charge your chosen payment method. If you choose an installment plan, you agree to all scheduled payments. Chargebacks or disputes may be reported to credit bureaus. We are not responsible for third-party payment processor issues.
23. Limitation of Liability: Ballistic Performance, LLC is not liable for any damages resulting from your use of the Site, services, or products. Your sole remedy for dissatisfaction is a refund for the amount paid, where applicable.
24. Indemnification: You agree to indemnify and hold harmless Ballistic Performance, LLC and its affiliates from any claims, damages, or expenses arising from your violation of these Terms.
25. Termination: We reserve the right to terminate your access to the Site or services if you violate any of these Terms.
26. Entire Agreement: These Terms, along with our Privacy Policy and Disclaimer, represent the entire agreement between you and Ballistic Performance, LLC.
27. Severability: If any part of these Terms is found to be unenforceable, the remainder remains in full effect.
